Health & Safety Enforcement at Encampments of Persons Experiencing Homelessness

This course will discuss the impacts of recent judicial decisions and/or settlement agreements pertaining to criminal enforcement of laws impacting persons experiencing homelessness and administrative actions to clean up encampments on public and private property. We will also discuss different strategies to safeguard the health and safety of the community as a result of such encampments.

Learning Objectives:

  • Understand the impacts of recent judicial decisions (including Martin v. City of Boise) and/or settlement agreements upon the enforcement of local regulations impacting homeless persons
  • Discuss strategies employed by local jurisdictions to protect the health and safety of the community from the hazards of encampments of persons experiencing homelessness

James Eckart is a partner at the Law Offices of Dapeer, Rosenblit & Litvak, LLP ("DRL"), where he has worked for over 20 years.  DRL serves as community preservation attorneys and City Prosecutors for approximately 50 municipalities throughout California enforcing the Cities' municipal codes and applicable State laws through administrative, civil, and criminal remedies. 

Mr. Eckart serves as the primary City Prosecutor for the Cities of Downey, Norwalk, Culver City, Covina, Industry, West Hollywood, Bell Gardens, Beverly Hills, and Montclair, as well as several other DRL clients. 

Mr. Eckart has drafted ordinances for municipalities on a wide array of topics, including, but not limited to, adult oriented businesses, massage establishments, graffiti, public nuisances, sidewalk vending, smoking restrictions, cost recovery, and administrative citations.
