Neighborhood Law Programs - Fighting Blight

Almost every city has abandoned, vacant, dilapidated, or criminal nuisance properties. These properties blight neighborhoods for years, while endangering communities, driving down property values and harming neighborhood morale. Neighborhoods hope and expect cities will fix the situation.

The problem with a nuisance property, is that it requires exploration and explanation before resolution can be reached.  For now, let us assume we are a neighbor next to a nuisance property that has been burned down for months.  At this property, transients dump trash and spend the night, while doing hard drugs and engaging in dangerous behavior. The burned down property becomes an eyesore. The transients, debris, and unsanitary conditions then endanger your community.  This becomes a major problem, but who do you call?  

The department that can often fix these major nuisance properties is the city attorney’s office, which has an arsenal of remedies to deal with nuisances. These remedies include Health and Safety Receiverships. Then there are other actions such as the Drug Abatement Act, Red Light Abatement and Nuisance lawsuits, as well as Vacant Property Ordinances, and Eminent Domain to name a few. 


California’s Current and Ever-Changing Cannabis Laws - Part One

With cannabis laws being relaxed or removed by states throughout the country, cannabis-related crimes are more prevalent than ever.

This class will discuss California’s new cannabis laws, the for-profit commercial cannabis industry, the changes to the Health and Safety Code, Department of Cannabis Control regulations, and NEW search and seizure issues for law enforcement personnel and the effects of legalization on our communities.

Additionally, the class will discuss current trends in and the investigative strategies for investigating indoor cultivation and concentrated cannabis lab operations, officer safety techniques, the societal impact of the cannabis subculture, and best practices when dealing with marijuana investigations.

Listen, Empathize, Agree and Partner (LEAP)

The LEAP® Course is a facilitator-led training workshop designed to provide participants the critical research and skillset required to create a therapeutic alliance and build a collaborative relationship with person(s) who have severe mental illness, that lead to the acceptance of treatment and services. This training is a highly effective set of tools used to communicate and build relationships with severely mentally ill (SMI) individuals who have anosognosia. This course will define anosognosia and how to work with individual’s presenting with anosognosia comprising of over 50% of those who have SMI. After completing this training, participants will be able to:

  • Identify anosognosia vs “denial” – how anosognosia affects 50% of patients with schizophrenia and bipolar disorders and once identified, take a different approach.
  • Set aside psychoeducation and logical arguments and instead focus entirely on developing a relationship with the mentally ill person so s/he feels respected, not judged and trusts the other person’s opinion that treatment would be beneficial to reaching personal goals.
  • Reduce anger, paranoia, and quickly gain cooperation and compliance.
  • Collaborate with the mentally ill person to work towards common goals.
  • Preserving and building on the relationship/ alliance when disrupted by disagreements, paranoia, involuntary treatment, etc.

Rental Housing Inspection Difficulties

As times change, so do the many duties and responsibilities of Code Enforcement Officers. Due to the numerous substandard housing complaints, a lack of habitable dwellings, fair housing violations, and a constant changing political environment, it is becoming more common to have Rental Housing Inspections throughout the United States. Code Enforcement Officers conduct the majority of these types of inspections. As many jurisdictions attempt to address these issues, they often encounter difficulties that are outside of their control. This training will identify the problems and difficulties with conducting inspections, implementing a Rental Inspection Program and analyze the possible solutions.

Unleashing Our Full Potential: Drones for Code Enforcement

CACEO’s favorite drone pilots are back! Two years ago, we presented on our new Drone Pilot Program. Drones are a highly beneficial tool that can be integrated into many code enforcement operations, and this initiative’s goal was to alleviate some inspection challenges that Code Enforcement Officers face. Curious about how it’s been going since?  This presentation will provide attendees with case studies on how drones have improved the safety of code enforcement officers, provide access to sites that may be physically inaccessible, and assist in conducting inspections more efficiently. In addition, this presentation will dive into how we’ve expanded our drone usage beyond code enforcement applications.  A live drone flight demonstration will be conducted as part of this session.

Drug Abatement - Red Light Abatement Acts

There are often properties that have major building violations. The violations are apparent to the naked eye. Cities can resolve the issues presented by these properties by red tagging the buildings, issuing citations, or simply warning the owner. Then if necessary, using Health and Safety Receiverships, codified at California Health and Safety Code sections 17980.6 & 17980.7.            

However, what can cities do to properties that to the naked eye look acceptable, but terrorize a neighborhood? These can be motels that are the site of numerous drug deals, prostitution, and extensive crime. Residential homes where the owner operates a casino that causes significant traffic into the night also fit into this category. This includes drunk fights at night, thefts, and other disturbances to the neighbors. For these situations that do not involve violations that are apparent to the naked eye the California legislature enacted two statutory schemes, which can be joined together. These statutory schemes can be found at California Health and Safety Code 11570 et seq and Penal Code 11225 et seq. These statutory schemes are informally known as the Drug Abatement and Red-Light Abatement Acts respectively.            

These are legal actions that can result in forcing the property to be boarded-up and closed, fined up to $25,000 and in certain scenarios appointing a receiver, along with numerous other remedies that are available for criminal nuisance properties that may not have typical building code violations.
